Terms of use
In effect. warpplaza is a fan community site, published by Hostynet.
1. Purpose
These terms of use (the "Terms") set out the rules for accessing and using the warpplaza site, a community space dedicated to Nintendo video games. warpplaza lets you join communities by game, post messages (text, stylus drawings, images), react, comment, create polls, customize your profile and connect with fellow fans. The site is published by Hostynet, a sole proprietorship operated by Alexandre Boukeras (see thelegal notice).
2. Acceptance of the Terms
By accessing the site and creating an account, you fully accept these Terms. If you do not accept these terms, you must not use warpplaza. Continued use of the service constitutes acceptance of the Terms in effect.
3. Access and account
You log in via Discord (OAuth) or with an email and password. You are responsible for keeping your credentials confidential and for any activity carried out from your account. You agree to provide accurate information and not to impersonate anyone else.
You can delete your account and all your data at any time from the Privacypage.
4. Minimum age and protection of minors
Registration is reserved for people aged at least 13. Your date of birth is requested at registration and accounts under 13 are rejected. If you are a minor, you declare that you have obtained permission from your parents or legal guardian to use the service and post content.
Protecting minors is a priority. Any predatory behavior, any sexual solicitation of a minor, any request for personal contact details from a minor, as well as any content depicting minors inappropriately, are strictly prohibited and will result in an immediate ban and, where applicable, a report to the relevant authorities.
5. Rules of conduct
The following are strictly prohibited on warpplaza:
- Harassment, insults, threats and intimidation.
- Hateful, racist, sexist, homophobic, transphobic or discriminatory remarks.
- Any illegal, violent, sexual, shocking content, or content inciting hatred or violence.
- Any child sexual abuse material (CSAM). This type of content is subject to zero tolerance, immediate removal and a report to the authorities.
- Sharing personal contact details in private messages (the contact-detail filters must not be bypassed).
- Spam, unsolicited advertising, scams and phishing.
- Pirated content: no ROMs, illegal download links, warez emulators or incitement to piracy.
- Circumventing moderation (for example, creating ban-evasion accounts after a ban).
- Posting content you do not hold the rights to.
6. No affiliation
warpplaza is not affiliated with, sponsored by, or endorsed by Nintendoor any of its partners. The game names and brands mentioned belong to their respective owners and are used only for identification purposes (nominative use) to allow discussion among fans. No visual belonging to Nintendo is used. The Plazu mascot and the logo are original creations of warpplaza.
7. Content ownership and license
You keep all your rights to the content you post (text, drawings, images). By posting it, you grant warpplaza a free, non-exclusive license to host, display and distribute this content on the site, for the sole purpose of running the community service. This license ends when you delete the content concerned or your account, subject to temporary technical copies and legal retention obligations.
8. Moderation and sanctions
Any content can be reported by members. The moderation team may hide content, issue a warning, suspend or ban an account in case of a breach of these Terms, without notice when the severity warrants it. The site may also be placed in maintenance mode. The goal is to keep things healthy and friendly.
Published images (posts, avatars, banners) are subject to automatic analysis. An image flagged as potentially sensitive is held for reviewby the moderation team and is not publicly visible until it has been approved. This analysis is performed in-house, with no transmission to any third party.
9. Private messages
Private messages are only available between members who follow each other. They are subject to automatic filtering of personal contact details. They are not end-to-end encrypted. In case of a report, the moderation team may view the content of the private messages concerned in order to handle the report and enforce these rules.
10. Liability
The service is provided "as is", within the limits of the technical resources available. Published content is the sole responsibility of its authors. Hostynet cannot be held liable for content published by users, nor for indirect damages resulting from use of the site. Hostynet makes reasonable efforts to ensure the availability and security of the service, with no guarantee that it will be free of interruptions or errors.
11. Changes to the Terms
Hostynet may modify these Terms at any time, in particular to adapt them to changes in the service or in regulations. Changes take effect as soon as they are published on this page. It is up to you to consult the Terms in effect regularly.
12. Governing law
These Terms are governed by French law. In case of a dispute, and failing an amicable resolution, the French courts will have jurisdiction.
